Terms of Service

Welcome to Punit Kumar (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our software, websites, and services (“Services”). By accessing or using the Services, you agree to these Terms.

1. Parties & Eligibility

These Terms are between Punit Kumar, registered at C/O Arun Kumar Bardhan, chandi kathwa, Ranipatra, PO: Ranipatra, DIST: Purnia, 854337, Purnia, Bihar, and the customer entity (“Customer”) and its authorized users. You must be of legal age and have authority to bind your organization.

2. Accounts & Access

• Customer is responsible for account configuration, user provisioning, and safeguarding credentials.
• You must keep your profile, billing, and contact details accurate and current.

3. Subscriptions, Fees & Taxes

• Services are billed per the plan you select. Charges recur until cancelled per our Subscription & Billing Policy.
• Fees are exclusive of taxes (e.g., GST/VAT). Applicable taxes are added at checkout or invoicing.

4. Use Restrictions

• No unlawful, infringing, or harmful content; no reverse engineering, scraping, or interference with the Service.
• Do not upload malicious code or attempt to bypass security or access controls.

5. Customer Content & IP

• Customer retains all rights to content it uploads. You grant us a limited right to process content to provide the Services.
• We retain rights to our software, UX, documentation, and brand assets.

6. Data Protection & Privacy

Our Privacy Policy explains how we collect, use, and protect personal data. If a Data Processing Addendum is required, it will apply to processing performed on Customer’s behalf.

7. Third‑Party Services

Integrations (e.g., e‑signature, video, storage) are provided by third parties under their terms. We are not responsible for third‑party services.

8. Availability & Support

We aim for high availability and timely support. Planned maintenance will be communicated where possible.

9. Security

We implement administrative, technical, and organizational controls. See our Security Overview for details. You are responsible for using strong authentication and access controls.

10. Warranties & Disclaimers

Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non‑infringement to the extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability under these Terms is limited to the amounts paid by Customer for the Services in the 12 months preceding the claim. We are not liable for consequential, indirect, or special damages.

12. Indemnity

Each party will indemnify the other against third‑party claims arising from its breach of these Terms or violation of law. We also provide standard IP infringement indemnity for our software (excluding Customer materials or misuse).

13. Term & Termination

• These Terms remain in effect while you use the Services.
• Either party may terminate for material breach not cured within 10 business days. You may cancel per the Refund & Cancellation Policy.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Choose jurisdiction—e.g., State of [X], India (courts at [City]) / England & Wales / Delaware, USA]. Venue and exclusive jurisdiction lie in the courts of that jurisdiction.

15. Changes to Terms

We may update these Terms. Material changes will be notified; continued use after the effective date constitutes acceptance.
